V-app Terms Of Use

 1. General principles

• V-App is an application connecting patients seeking medical examination and treatment, and those in need of medical care, with Vinmec. V-App operates on a free-of-charge basis and is not independent in any activities related to medical examination and treatment, medication dispensing, or other medical services/activities. V-App is not the sole and official site providing medical information and guidance of Vinmec. All of the information, medical examination and treatment activities, and patient examination and treatment must be guided, advised, and confirmed by authorized medical staff.
• By installing/registering/using the support features in V-App (“application”), users confirm that they have read, understood, and agreed to all the contents of these V-App Terms of Use (hereinafter referred to as “Terms”) and accompanying policies (including Vinmec’s Personal Data Protection Policy).
• When choosing to use the application, users must be of legal age. Users who are under 16 years old must register and use the application under the guidance and agreement of their parents or legal guardians. For citizens of territories where the law is different, users must comply with those specific regulations.

2. Prohibited actions

Users are not allowed to use the application to perform actions prohibited by law on cybersecurity and information technology, as well as other relevant regulations, including but not limited to:

• Using the application to obstruct the operation of the Vietnam national domain name system ".vn", the lawful operation of internet service providers and information on the network.
• Using the application to obstruct the provision and access to legal information, and the provision and use of lawful internet services by organizations and individuals.
• Using the application to illegally use passwords, cryptographic keys of organizations and individuals; private information, personal information and internet resources.
• Using the application to access images as well as using the application interface and creating unauthorized links to the lawful domain names of organizations and individuals.
• Using the application to create, install and distribute malware and computer viruses; illegally accessing and taking control of information systems; creating attack tools on the Internet.
• Using the application to interfere with Vinmec's services by any means, programs or methods.
• Using the application to disseminate, spread, or promote any activities aimed at interfering with, disrupting, or infiltrating the data of the service provider or server systems, or disseminating prohibited information as stipulated by law.
• Using the application to perform acts, and/or express attitudes that harm the reputation of Vinmec and/or its services, or other individuals or organizations in any form or manner.
• Other prohibited acts as stipulated by Vietnamese law in each field.

3. Rights and obligations of V-app users

• Users are guaranteed the confidentiality of their personal information in accordance with this Regulation and the Personal Data Protection Policy on V-App. Accordingly, the personal information provided by users will only be used by Vinmec for activities on V-App and will not be provided to any third party that is not a partner providing services directly to V-App's operations, and only within the scope and limits necessary to serve the mentioned purpose; all other cases will require the user's consent, except in cases where required by Competent State Agency or as stipulated by Vietnamese law.
• Users have the right to request the provision of personal information collected from them during the registration/use of the application.
• Users are obligated to read and acknowledge their agreement to the contents of these regulations and any amendments (if any).
• Users are obligated to comply with regulations on information security, data protection, and other relevant regulations as stipulated by Vietnamese law and these Regulations.
• Users must fully compensate Vinmec for any damages incurred if they violate these regulations and/or violate the law resulting in losses, damage to Vinmec's property and reputation, including costs related to settlement such as court fees, lawyer fees, consultant fees, and other costs related to resolving the case.

4. Rights and obligations of Vinmec

• If the information registered and provided by the user is untrue, inaccurate, or if Vinmec has reason to believe that the information is inaccurate, Vinmec has the right to refuse to assist and resolve the user's requests.
• Vinmec receives and resolves complaints and requests of users in accordance with Vietnamese law.
• Vinmec is responsible for protecting personal information in accordance with Section 6 of these Regulations and Vinmec's Personal Data Protection Policy, as well as relevant provisions of Vietnamese law.

5. Violation handling mechanism

• If you have a complaint regarding information deemed to be in violation and/or any other issues related to the violation handling mechanism stipulated in this Regulation, please submit a support request at https://www.vinmec.com/

6. Information privacy policy on V-app

Process of personal data collection and data handling:

• The registration process for using V-App application will require you to provide personal information. The information is collected and processed to support users in connecting with facilities/ hospitals in medical examination and treatment activities and to increase user benefits.
• Users' personal information will not be used for any other purpose without the prior consent of the user. We are entitled to provide your information to third parties in cases stipulated by law, including but not limited to:|
   - Users have consented through acceptance of these Regulations or consent at any period;
   - At the request of Competent State Authority; or as required by law.
• During the use of the application, users agree to receive notifications and advertisements from Vinmec using personal information they have provided.
• Vinmec is permitted to use the information provided by users to conduct research activities to develop services to better serve users.

Personal data privacy policy:

• The best security measures will be provided and used to protect the personal data provided by users within capacity of Vinmec and those development partners at V-App.
• The requirements of Vietnamese law regarding the protection of personal data are detailed in the Personal Data Protection Policy published by Vinmec at http://Vinmec.com/vie/bai-viet/chinh-sach-bao-ve-du-lieu-ca-nhan-cua-cong-ty-co-phan-benh-vien-da-khoa-quoc-te-vinmec. Users and Vinmec agree to implement the policy (including rights, obligations, data processing procedures, and handling of complaints regarding personal data requests) as published in accordance with Vietnamese law.

7. Intellectual property rights

• Vinmec and its application development partners have full ownership rights over intellectual property assets as stipulated by law. The use of any of Vinmec's intellectual property rights without prior written permission constitutes infringement of those rights.
• In addition to specific written consent for the intellectual property rights and the authorized users, we do not grant permission in any other forms, whether explicit or implicit, for users to implement the mentioned rights.

8. Modifications and additions

• The contents of these Regulations may be modified or supplemented without prior notice to users. Modified or supplemented information will be published on V-App and will take effect from the date of publication. Users who download the update (manually or automatically) and continue to use the application are obligated to read and acknowledge the changes. By continuing to use the application, users acknowledge their agreement to the changes we have made.

9. Effectiveness

• This regulation (including any amendments or additions at any period) is applicable and effective from the date of issuance/publication on V-App.
